If you’ve never done it before, it’s really easy to check whether that new name or tagline you came up with is already trademarked by some other genius. Just go to the US Patent & Trademark Office, click “Trademark” on the right, then “Search TM Database” in the drop-down. Choose “New User Form (Basic)” and type in the term you want to check on. The general rule is that you can have a duplicate name or tag, as long as it’s in a separate industry. Typically, you’ll have to get a trademark lawyer to solidify it and the price is around $1,500.
